Since 25 May 2018, the Regulation (EU) of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data has been in force, referred to as the “GDPR”.

Therefore, we would like to inform you about the principles of processing personal data by SaMASZ Sp. z o.o. and about your rights in this regard. We want you to be provided with complete information, and thus have full comfort of using SaMASZ Sp. z o.o. services and systems. Therefore, before you start using our websites and platforms, please read the information below.

At the same time, we ensure that we take due care of your privacy and do not extend our rights in any way. Your personal data are safe with us, and your consent to its collection and processing may be withdrawn at any time, in accordance with the provisions below.

SaMASZ Sp. z o.o. with its registered office in Zabłudów, 16-060, ul. Trawiasta 1, entered into the Register of Entrepreneurs under KRS No.: 0000011382, for which the registration files are maintained by District Court in Białystok, 12th Commercial Division of the National Court Register, NIP (Tax Identification No.): 966-159-29-76, REGON (National Business Registry No.): 052025784.

As the controller of personal data, we collect your personal data when you enter into a contract with us and during the term of the contract, in particular:

  • first name(s) and surname, e-mail addresses, contact address, the business name of the entity being represented, phone number, position,
  • in the case of entrepreneurs, we also process: NIP (Tax Identification No.), REGON (National Business Registry No.), address of the registered office, bank account number,
  • in the case of entrepreneurs applying for a credit limit at SaMASZ Sp. z o.o., we also process the data contained in financial documents.

We collect your personal data for the following purposes:

  • to conclude and perform a contract between us and to provide you with services offered by us, including, in particular, dispatch of ordered goods and making payments, complaint handling,
  • to perform the obligations of SaMASZ Sp. z o.o. provided for by law, including, in particular, the issue and storage of invoices and accounting documents, and for archiving purposes,
  • to protect the rights of SaMASZ Sp. z o.o. in accordance with legal regulations, including, in particular, the pursuit of overdue payments through debt recovery and court proceedings,
  • to verify your payment credibility and creditworthiness when granting you a credit limit as well as in order to secure payments due (surety agreements and other collaterals),
  • the legitimate interest of SaMASZ Sp. z o.o. within the meaning of the regulations on personal data protection, including the marketing of products and services of SaMASZ Sp. z o.o. (direct marketing),
  • to carry out marketing activities and send commercial information in the event of your separate consent.

SaMASZ Sp. z o.o. may transfer personal data to the following third parties for the purposes specified in this document:

  • entities with whom SaMASZ Sp. z o.o. has concluded a cooperation agreement in order to perform the contract between us, to perform the obligations of SaMASZ Sp. z o.o. provided for by law, to protect the rights of SaMASZ Sp. z o.o. in accordance with the law and to pursue the legitimate interest of SaMASZ Sp. z o.o. within the meaning of the regulations on the protection of personal data; in particular, SaMASZ Sp. z o.o. may transfer your personal data to such entities as: banks, debt collection companies, entities providing accounting services, companies providing postal and courier services, companies we work with to provide marketing services. Such entities will be obliged under the agreements concluded with SaMASZ Sp. z o.o. to apply appropriate security, technical and organisational measures to protect personal data and to process it only in accordance with the instructions provided by SaMASZ Sp. z o.o,
  • supervisory authorities, authorities and other third parties where this is necessary in order to achieve the objectives set out above and to fulfil the obligations imposed by law, personal data may be transferred to supervisory authorities, courts and other authorities (e.g. tax and law enforcement authorities), independent external advisers (e.g. auditors) or service providers.

SaMASZ Sp. z o.o. undertakes to apply appropriate security measures, both technical and organisational, to protect your personal data. Personal data will be stored by SaMASZ Sp. z o.o only for the time necessary to achieve the objectives, for which the data are collected, to perform legal obligations, for a maximum period of time necessary to secure the materials necessary for legal proceedings (including tax) and until the possible statute of limitations of your and SaMASZ Sp. z o.o. claims.

In addition, you have the right to:

  • object to the processing of data

An objection may be raised when we process your data due to our legitimate interest, with which you do not agree. If the objection proves to be justified, the data will be removed.

  • have your data rectified (corrected), if the data processed are inaccurate or incomplete
  • have your data erased (be forgotten)

You can request the deletion of your personal data in situations where: - the consent on the basis of which the personal data were processed has been withdrawn, - the data are not necessary for the purposes, for which they were collected, - an objection to the processing of the data has been raised, - personal data are processed unlawfully.

  • limit the processing of data

You may requested that SaMASZ Sp. z o.o. does not to process certain personal data (except for their storage), but without completely removing them.

  • access data

The law allows to obtain information whether SaMASZ Sp. z o.o. processes personal data, what data are processed, for what purpose and at what time, and to obtain a copy of your personal data.

  • transfer data

You may request that the data held by SaMASZ Sp. z o.o. be prepared in a structured form, in a commonly machine-readable format, and/or request that they be transferred to another Data Controller.

  • lodge a complaint

A complaint may be lodged with the data protection supervisory authority, if you consider that the processing of your personal data violates the provisions of Regulation 2016/679.

Collection and processing of personal data from the website

Visiting the website of SaMASZ Sp. z o.o. by you is connected with the recording of information about, among others, your Internet browser, operating system, the address of the website from which you are redirected, the address of the websites you visit on our website, the date of your visit to the SaMASZ website, and the IP address assigned to you by the Internet service provider.

SaMASZ Sp. z o.o. uses so-called plug-ins of social networks, such as Facebook, YouTube, Linkedin. On our website, these plug-ins are deactivated as standard, i.e. they do not send any data to social networks without your participation. Plug-ins can only be used after they have been activated with a mouse click. A plug-in remains active until you deactivate it or until you delete your cookies. SaMASZ Sp. z o.o. also uses solutions such as Facebook Pixel, Google remarketing code, tracking codes to provide marketing information and improve the website.

Cookies policy

  1. Cookies are text files that are stored on the the user’s terminal device’s hard drive and are used by the server to recognize the user’s device while reconnecting. Cookies are downloaded at each “entry” and “exit” from the website. Cookies are not used to identify users but only their devices.
  2. SaMASZ Sp. z o.o. uses cookies to recognise and remember information about users. This makes it possible to identify individual user needs more precisely and thus to offer them better and more tailor-made services.
  3. Any user may refuse to allow the inclusion of cookies on his/her terminal device. In order to do this, you must use the option of disabling the downloading and storing of cookies on your Internet browser.   4. The removal of cookies may lead to the loss of the possibility to use some of the functionalities of SaMASZ Sp. z o.o. websites.

Cookies may also be used by SaMASZ Sp. z o.o. for the following purposes: - cookies which enable the use of the services available on the website, - cookies for security purposes, - cookies enabling the collection of information on how to use the website, - cookies which enable the user to remember the settings selected by him/her and to personalise the user interface, - cookies enabling the provision to users of advertising content more relevant to their interests, remembering the settings selected by the User and personalising the User Interface, remembering the history of the sites visited on the website in order to recommend the content of the Website, maintaining the session of the User of the website, thanks to which the user does not have to re-enter his/her login and password on every subpage of the website, creating a basket of orders - cookies collecting statistics.
